Translation of Book of Penal Law
Penal Law should not be entitled by its rules and orders to have control over political persuasions of citizens, and even more, configure them, their aspects of several social subjects, their intentions and disposals as such. Penal Law should not be created in a way, to manipulate personality of citizens and their free will, free thought and social as well as political concepts as such. As we know, freedom and free will, are supported by Constitution already, and as we know Press, as the 4th said authority/power, of which definition was officially given by Constitution created after 1793 and French Revolution, to work free, to publish and announce, free opinion on several subjects of journalists, thus protecting the right of verbal freedom, which is also a kind of freedom. By no means, should then Penal Law, under threat of punishment, impose special/specific rules and orders to that direction, all this in States and hence Societies of Republic; otherwise the right to vote, as political right expressing the political freedom to vote and elections of adults should have no (legal) reason and substance to exist, contrinuting also and expressing the main principle of relative Article of Constitution to self-disposal and free will, that leads to free development of personalities, within a demcratic regiment, and not as Regiments of Absolutism, under one single Leader and Chief, who in the past of history of many countries of Europe, as long as these Monarchs existed as sovereigns of state, used to claim I am the State (Louis, XIV, prior to Louis XVI, the King under reign of whom, French Revolution took place..etc
Thus penalization of acts only being immoral ones, cannot apply in pure concept of Penal Law, it has indeed to perturbate, social balance, by harming legal rights of parties, but should be penalized, to the measure they may, by harming penal rights, offend moral values, expressed as social values, when these certain rights, which express these values, are protected by articles of Constitution, deriving from relative principles, and leading to relative legal concepts, concepts of Law, mainly those who represent absolute rights, and those absolute rights who fall in the sphere and field of fundamental rights.
